(“Company”, “We”, “Us”, or “Our”) collects, uses, processes, shares, and protects Your information when You use the Tonight mobile application, the website at usetonight.com, and related services (collectively, the “Service”).

By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy. If You do not agree, please do not use the Service.

1. Interpretation and Definitions

1.1 Interpretation

Capitalized terms have the meanings assigned to them in this Policy.

1.2 Definitions

  • Account means the unique profile created for You to access the Service.
  • Applicationmeans the mobile application titled “Tonight” available on the Apple App Store.
  • Company, We, Us, or Our means Shanghai Sujian Intelligent Technology Co., Ltd., a company registered in Shanghai, China.
  • Device means any device used to access the Service, including iPhone and iPad.
  • Personal Data means information that identifies or can reasonably be linked to an individual.
  • Sleep Data means information You provide or generate through the Application relating to Your sleep schedule, sleep quality records, and habit check-ins.
  • Usage Data means data collected automatically through use of the Service, such as device type, operating system, and app version.
  • Website means usetonight.com.
  • You means the individual using the Service.

2. Information We Collect

We collect information relevant to sleep habit tracking. The specific categories may vary based on the features You use and may evolve as the Application develops. Certain features may request optional access to Device sensors, Apple Health data, or other permissions; when You grant such access, We collect the data necessary to operate the feature, and You can revoke permission at any time in Your Device settings.

2.1 Information You Provide

When You create an Account or use the Service, We may collect information such as:

  • Name (optional, provided by the sign-in provider or entered by You)
  • Birth year (optional, provided during onboarding)
  • Time zone derived from Your Device settings
  • Other account, profile, or preference information You choose to provide

2.2 Sleep and Habit Data

To provide habit tracking and sleep guidance, the Application may store information such as:

  • Target bedtime and wake-up time
  • Habit configuration (which habits are enabled, hidden, or auto-checked)
  • Daily habit check-ins (which habit was completed on which date)
  • Sleep quality logs (Your self-reported sleep quality per night)
  • Sleep progress (plan start date, perfect-day count, current step in the program)
  • The date You completed onboarding and the date of Your last sleep review
  • Journal entries, notes, mood or self-assessment responses, and other sleep- or habit-related information You choose to provide through the Application

When You are signed in, Sleep and Habit Data is synchronized to Our cloud backend so You can restore Your data on a new device.

2.3 Subscription Information

Subscriptions are purchased through the Apple App Store. Payment processing is handled by Apple. We do not store full credit card numbers or payment credentials. Apple handles payment data according to its own privacy policy.

2.4 Device and Technical Information

The Application transmits technical information to Our backend as part of normal API requests, such as:

  • Device type, operating system version, and Application version
  • Device identifiers permitted by the platform
  • IP address (processed by Our infrastructure provider for security and routing)
  • Time stamps of API requests
  • Crash reports, diagnostics, feature usage, and performance metrics
  • Other technical or diagnostic information reasonably necessary to deliver, secure, and improve the Service

We may use third-party service providers, including analytics and crash-reporting tools, to help operate and improve the Service. These providers process Device and Usage Data to help Us maintain and improve the Service.

2.5 Aggregated Analytics and Service Improvement

We may analyze Sleep and Habit Data in aggregated or de-identified form to:

  • Understand how different features affect sleep outcomes across Our user base
  • Improve habit recommendations, schedules, and default settings
  • Develop new features and evaluate product performance
  • Conduct internal research on sleep behavior patterns

When used for these purposes, the data is aggregated across many users or stripped of identifiers so it cannot reasonably be linked back to You. We do not sell this data to third parties.

  • Synchronize Your sleep settings, habit check-ins, and progress across Your devices
  • Determine Your subscription entitlement

  • Analyze feature usage, retention, and reliability through aggregated analytics
  • Research and improve habit effectiveness, default schedules, and recommendation quality

7. Data Retention

We retain Personal Data for as long as reasonably necessary to provide the Service, maintain Your Account, support habit-tracking features, process subscriptions, and comply with legal or regulatory obligations such as financial, accounting, tax, or audit requirements.

The retention period may vary depending on the type of information and the purpose for which it was collected. Backups may persist for limited periods as part of standard retention practices.

When You delete Your Account or submit a verified deletion request, We will take reasonable steps to delete or permanently anonymize the associated Personal Data within a reasonable timeframe, unless retention is required to comply with law, resolve disputes, enforce Our terms, detect security incidents, or maintain necessary business records.

Where technically feasible, anonymized or aggregated data that no longer identifies You may be retained for analytics, research, or product improvement purposes.

9. Deleting Your Account and Data

You may delete Your Account at any time from the Profile screen inside the Application. Deleting Your Account will:

  • Permanently remove Your profile, sleep settings, habit check-ins, sleep logs, and progress from Our active databases
  • Cancel further synchronization from Your Device

Some data may persist where retention is legally required.

10. Security

We implement administrative, technical, and physical safeguards designed to protect Your information. However, no method of transmission or storage is completely secure, and We cannot guarantee absolute security.

11. Security Incidents

In the event of a confirmed data security incident involving unauthorized access to Personal Data, We will take reasonable steps to investigate, mitigate potential harm, and provide notice where required by applicable law. Notifications may be delivered through email, in-Application notification, the Website, or other reasonable communication methods.

12. Children’s Privacy

The Service is not directed to children under the age of 13 (or the equivalent minimum age in Your jurisdiction, where higher). We do not knowingly collect Personal Data from children under 13.

The Service relies on third-party authentication and payment providers as described in Section 5. The Service may also contain links to third-party websites that We do not operate. Analytics providers may process Device and Usage Data in order to generate aggregated insights about how the Service is used. We do not use Sleep or Habit Data for advertising targeting or marketing profiling.

Where applicable, You may manage certain tracking preferences through Your Device settings, including resetting advertising identifiers or limiting tracking permissions.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The updated version will be indicated by a revised “Last Updated” date and will be effective as soon as it is posted at usetonight.com/privacy. For material changes, We will provide additional notice through the Application or by email.
